Terms of Service

These Terms of Service ("Terms") govern your use of First Light Word, an SMS-based spiritual guidance service ("Service") operated by BornTall LLC ("BornTall," "we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

§ The Service

First Light Word is an SMS-based service that delivers AI-generated spiritual content and guidance in the voice of Jesus Christ. The Service is intended for personal spiritual reflection and encouragement. It is not a licensed counseling or therapy service, a crisis intervention service, a medical or mental health service, or a substitute for professional pastoral care.

Content generated by the Service is produced by an artificial intelligence system and is not authored by a human pastor, counselor, or theologian. While we work to ensure responses are grounded in scripture and consistent with Christian teaching, we make no guarantee of theological accuracy or completeness.

§ Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that you have parental or guardian consent.

§ SMS Consent & Communication

By texting the Service, you expressly consent to receive automated SMS messages from First Light Word, including transactional messages, spiritual content, and promotional messages related to the Service. Message and data rates may apply.

You may opt out at any time by replying STOP. After opting out, you will receive a single confirmation message and no further messages unless you re-engage. For help, reply HELP.

§ Credits & Billing

The Service offers 5 free messages and paid credit packs purchased as one-time transactions through Stripe. Credit packs are not subscriptions — there is no recurring charge. Credits never expire and are tied to your phone number.

Available credit packs: Starter (50 messages, $4.99), Seeker (150 messages, $12.99), Disciple (400 messages, $29.99), and All In (1,000 messages, $59.99). Any purchase permanently unlocks daily broadcasts (Verse of the Day, Song of the Day, Devotional) for your account.

A Church / Group plan ($149/mo, 10 seats) is available for small groups and pastors and is billed on a recurring monthly basis. By purchasing a Church / Group plan, you authorize BornTall to charge your payment method each month until you cancel. Cancellation takes effect at the end of the current billing period.

All purchases are processed by Stripe. We do not store credit card numbers or payment details on our servers. Credit pack purchases are non-refundable except where required by law. We reserve the right to change pricing at any time with advance notice via SMS.

§ Acceptable Use

You agree not to use the Service to:

  • Harass, threaten, or harm others
  • Attempt to manipulate or jailbreak the AI system
  • Impersonate any person or entity
  • Transmit spam, automated messages, or bulk communications
  • Violate any applicable law or regulation
  • Use the Service for any commercial purpose without our written consent

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms.

§ Crisis & Emergency Situations

First Light Word is not a crisis service, a suicide prevention service, a mental health intervention service, or an emergency response service of any kind. It is not monitored by humans in real time. No one at BornTall LLC will call you, dispatch emergency services on your behalf, or intervene in any crisis situation.

IF YOU ARE IN IMMEDIATE DANGER OR EXPERIENCING A MENTAL HEALTH EMERGENCY, STOP USING THIS SERVICE AND CONTACT EMERGENCY SERVICES IMMEDIATELY:

By using the Service, you acknowledge and agree that First Light Word is not a substitute for professional crisis intervention, emergency services, or mental health care, and that BornTall LLC bears no responsibility or liability for outcomes in any crisis or emergency situation.

§ Our Crisis Protocol — How the Service Responds

We have implemented a good-faith automated crisis protocol within the Service. You should understand what this protocol does and does not do.

What the Service is designed to do:

  • When the AI system detects language that may indicate suicidal ideation, self-harm, or imminent danger, it is designed to immediately surface crisis resources including 988 and the Crisis Text Line
  • In such situations, the Service is designed to lead with care rather than spiritual or theological content
  • The Service is designed to encourage users to seek professional help and contact crisis services

What the Service cannot do and does not do:

  • The Service cannot detect all crisis situations. The AI may not recognize crisis language in all cases, including indirect, coded, or ambiguous language.
  • The Service does not alert BornTall LLC, emergency services, or any third party when crisis language is detected.
  • The Service does not dispatch help, contact your emergency contacts, or take any real-world action on your behalf.
  • The Service is not monitored by humans in real time. No person at BornTall LLC reads your messages as they are sent.
  • The Service cannot guarantee that its automated crisis response will be triggered in every situation where it may be appropriate.
  • Response times are not guaranteed. The Service may be unavailable, delayed, or experience errors.

By using the Service, you expressly acknowledge:

  • You understand the limitations of the automated crisis protocol described above
  • You will not rely on the Service as a primary or sole resource in any crisis or emergency situation
  • You will contact 911, 988, or another qualified crisis service directly in any emergency
  • BornTall LLC bears no liability for any harm arising from your use of or reliance on the Service in a crisis or emergency situation, including personal injury, psychological harm, or death

§ Intellectual Property

The First Light Word name, branding, and Service design are owned by BornTall LLC. Scripture passages used in the Service are from the Berean Standard Bible (BSB), which is in the public domain. AI-generated responses are produced on your behalf and you may use them for personal, non-commercial purposes.

You retain ownership of the content you send to the Service. By sending messages, you grant BornTall a limited license to process and store your messages solely to provide the Service.

§ Assumption of Risk

BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

You understand that:

  • The Service is powered by artificial intelligence and does not provide licensed medical, mental health, psychological, pastoral, legal, or financial advice of any kind.
  • AI-generated content may be inaccurate, incomplete, or inappropriate for your specific situation.
  • The Service is not a substitute for professional medical, mental health, crisis, or pastoral care.
  • No response from the Service should be relied upon in any life-critical, health-critical, or emergency situation.
  • You are solely responsible for all decisions and actions you take based on content received through the Service.

You voluntarily assume all risks associated with your use of the Service, including but not limited to risks of emotional distress, spiritual confusion, reliance on AI-generated content, and any outcomes resulting from actions taken or not taken based on the Service.

§ Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, COMPLETENESS, TIMELINESS, OR NON-INFRINGEMENT. BORNTALL LLC MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY BORNTALL LLC OR ITS REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

BORNTALL LLC EXPRESSLY DISCLAIMS ALL LIABILITY FOR THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CONTENT GENERATED BY THE SERVICE, INCLUDING SPIRITUAL GUIDANCE, SCRIPTURAL INTERPRETATION, OR ANY OTHER INFORMATION PROVIDED THROUGH THE SERVICE.

§ Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BORNTALL LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "BORNTALL PARTIES") SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

  • Direct, indirect, incidental, special, consequential, exemplary, or punitive damages
  • Personal injury, bodily injury, emotional distress, psychological harm, or death
  • Loss of profits, revenue, data, goodwill, or other intangible losses
  • Damages arising from reliance on AI-generated content
  • Damages arising from crisis situations, mental health emergencies, or self-harm
  • Damages arising from any interruption, suspension, or termination of the Service
  • Any other damages arising from your use of or reliance on the Service

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH SUCH DAMAGES ARE SOUGHT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF BORNTALL LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF THE BORNTALL PARTIES TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO BORNTALL LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, THE BORNTALL PARTIES' LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

§ Release of Claims

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE THE BORNTALL PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, LIABILITIES, DAMAGES, LOSSES, COSTS, AND EXPENSES OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, ARISING FROM OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO CLAIMS ARISING FROM PERSONAL INJURY, DEATH, PROPERTY DAMAGE, EMOTIONAL DISTRESS, RELIANCE ON AI-GENERATED CONTENT, OR ANY CRISIS OR EMERGENCY SITUATION.

IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY." YOU WAIVE ANY SIMILAR PROTECTIONS UNDER THE LAWS OF ANY OTHER STATE OR JURISDICTION.

§ Indemnification

You agree to defend, indemnify, and hold harmless the BornTall Parties from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of or access to the Service; (b) your violation of any provision of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any content you transmit through the Service; or (e) your violation of any applicable law or regulation. This indemnification obligation will survive termination of these Terms and your use of the Service.

§ Dispute Resolution & Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED EXCLUSIVELY BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS CONSUMER ARBITRATION RULES. YOU AND BORNTALL LLC EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION.

You may opt out of this arbitration agreement within 30 days of first using the Service by contacting us at legal@firstlightword.faith with the subject line “Arbitration Opt-Out.”

§ Governing Law

These Terms are governed by the laws of the United States and the state in which BornTall LLC is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in that state.

§ Changes to These Terms

We may update these Terms at any time. When we do, we will update the effective date above. Continued use of the Service after changes constitutes acceptance of the updated Terms. For material changes, we will provide advance notice via SMS.
